Introduction

This Privacy Statement contains information about the personal data we, Daikin Chemical Europe GmbH, Am Wehrhahn 50, 40211 Düsseldorf, Germany, collect, process and use (in the following summarized as “processing”) during the use of our website www.daikinchem.de (“Website”).

We take protection of your personal data very seriously. Therefore, we process your personal data in compliance with the applicable data protection rules, in particular the General Data Protection Regulation ("GDPR").

Please take into account that you are not obliged to provide the personal data as described below. However, in case personal data is not provided, we may not be able to provide the full functionality of our Website and/or our services.

Processing of Usage Data

When you visit our Website, we receive the following information regarding the use of the Website (so called "Usage Data"):

  • Your operating system (OS);
  • Your web browser used to access our Website;
  • The website which has led you to our internet presence;

Processing of Contact Data

When you contact us via the contact form offered on our Website, or send us e-mails with requests or enquiries, for example when you require information about our goods and services, we process the personal data you provide to us in order to handle your requests. Such personal data include your name and email-address as well as further information, for example your company name and country if provided by you (so-called "Contact Data"). Legal basis for the processing of your personal data for the aforementioned purposes is Art. 6 Para. 1 lit. b) GDPR.

Consent to the Transfer of Contact Data

In order to handle your requests properly, we may also transfer your Contact Data to other companies of the Daikin Group (“Affiliates”) which are located in other jurisdictions than the jurisdiction where you are resident. We will only transfer such personal data to our Affiliates with your consent (Art. 6 Para. 1 lit. a) GDPR). In this case the data that is being transferred is subject to appropriate technical and organisational data protection measures. If you want to withdraw your consent please refer to the Section “Your Rights” below.

Third Parties

Other than handling your requests, we will not transmit your personal data without consent to any third parties, except where we are entitled or obliged by law, receive an official request by a court or authority or where we engage external data processors who support us in the performance of our goods and services, including inter alia the technical provision of this Website, and act only on our behalf (see also Section “Service Providers”).

Service Providers

The responsibility for personal data processed during the use of the Website remains at Daikin Chemical Europe GmbH. We may also engage external data processors, including their sub-contractors, with the processing of personal data on our behalf in order to support us with the provision of our goods and services, including inter alia the technical provision of this Website.

The personal data you provided us may be processed or stored at computers located in other jurisdictions whose data protection laws may be different from the jurisdiction of your place of residence.  In this case, appropriate technical and organisational measures for data protection are taken to ensure an adequate level of protection. We remain the data controller.

Data Storage Term

Your personal data will be stored by us or our data processors only for the period necessary to carry out our services and in accordance with the applicable laws and regulations. For example, if you contact us via a contact form, we store the personal data until the respective inquiry is completed. However, we might be subject to statutory or contractual regulations (such as commercial law) which oblige us to store the personal data for a longer period. In this case, the storage period may amount between two (2) to ten (10) years.

Security

Technical and organizational security measures are being used in order to protect your personal data from being manipulated, lost, destructed or accessed by unauthorized persons.  When personal data is collected, such data will be encrypted in transit to prevent misuse of the data by any third parties. Our security measures are continuously reviewed or improved in light of the technological development.

Use of Google Analytics

This Website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses so-called “cookies”, which are text files that are stored on your computer and allow an analysis of the use of the Website by you. We use Google Analytics in order to improve the content and functionalities on our Website. Legal basis for the processing is Art. 6 Para. 1 lit. f) GDPR.

The information generated by the cookies about your use of this Website are usually transmitted to a server of Google in the United States and stored there. You can find further information about the personal data processed by Google Analytics in the privacy policies provided by Google.

On behalf of the owner of this Website, Google will use this information to evaluate your use of the Website, to compile reports about the website activities and to provide further services related to website activity and internet usage for website operators.  IP address sent through Google Analytics from your browser is not associated with other data of Google.

In case of activation of IP anonymization on this Website, your IP address is truncated by Google within member states of the European Union or in another contracting parties to the Agreement on the European Economic Area.  Only in exceptional cases, the full IP address is transmitted to a server of Google in the United States and truncated there. IP anonymization is activated on this Website. We amended Google Analytics with the “anonymizeIP” code, to ensure an anonymized storage of IP-addresses (so-called IP masking).

Your rights

You may request from us access to (Art. 15 GDPR), rectification of (Art. 16 GDPR), or erasure of (Art. 17 GDPR) your personal data in compliance with the applicable statutory provisions. Where the deletion of your personal data is not possible due to contractual or statutory requirements, in particular retention obligations based on fiscal or commercial law, personal data will be blocked (Art. 18 GDPR). In case you gave your consent to the transfer of your personal data to third parties pursuant to Section “Consent to the Transfer of Contact Data” you may withdraw your consent anytime by notifying us of the withdrawal (see below). In this case, we will no longer process your personal data. The withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

Right to lodge a complaint with a supervisory authority

Right to object

You have the right to object (Art. 21 GDPR), on grounds relating to your particular situation, at any time to processing of your personal data which is based on Art. 6 Para. 1 lit. f) GDPR, including profiling based on those provisions. We will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.
